Section 1

Service Description

Visavvy LLC ("Visavvy," "we," "us," "our") operates a technology-assisted appointment monitoring and booking service for VFS Global visa application centers ("VFS") in the United States, in connection with Portugal long-stay visa applications (D7, D8, D2, and Golden Visa pathways).

Our service consists specifically of:

  • Automated monitoring of VFS appointment availability at one or more designated US locations on your behalf
  • Notification to our team when appointment slots matching your stated preferences become available
  • Attempted completion of an appointment booking on your behalf using the information and credentials you provide
  • Delivery of booking confirmation details to you upon successful appointment completion
  • Optional coordination of additional VFS services (courier, photograph, SMS updates, photocopy, and printing) at your request
Our service ends at appointment confirmation. We are not responsible for anything that occurs after an appointment is booked — including visa processing, consulate decisions, document reviews, or the outcome of your appointment visit.

Section 2

What We Cannot Guarantee

By nature of the service we provide, the following outcomes are outside our control and are expressly not guaranteed:

  • Appointment availability. VFS Global controls the release of appointment slots. We have no influence over when, how many, or whether slots become available at any given location.
  • Booking timeline. We cannot guarantee that an appointment will be secured within any specific period. Wait times depend entirely on VFS slot releases, which are unpredictable and vary by location and season.
  • Successful booking. Even when a slot is detected, it may be claimed by another party in the milliseconds between detection and booking attempt. We will always attempt booking immediately, but cannot guarantee success on any given slot.
  • Preference matching. While we make every effort to match your stated day, time, and window preferences, the first suitable slot will always be booked immediately upon appearance. Preferences are a guide, not a guarantee.
  • Uninterrupted monitoring. VFS Global may implement technical measures, rate limiting, or access restrictions that temporarily prevent our monitoring system from operating. We will restore monitoring as quickly as possible in such cases.
  • Visa approval. Visavvy has no connection to or influence over the Portuguese consulate or AIMA. Visa approval decisions are made solely by Portuguese immigration authorities based on your application.
  • VFS system stability. VFS Global may change their booking platform, appointment categories, or procedures without notice. We will adapt our service accordingly but cannot be responsible for disruptions caused by such changes.

Section 3

What Is Not Included

Our concierge fee does not include and we do not provide:

  • Document preparation, review, or verification for your visa application
  • FBI background check coordination or apostille services
  • Translation of documents
  • Legal or immigration advice of any kind
  • Representation before the Portuguese consulate or AIMA
  • VFS government fees (~$43.91 per applicant), which are paid directly to VFS
  • Any VFS add-on services not pre-selected on your intake form
  • Travel arrangements for your appointment visit
  • Post-appointment support or visa tracking

Section 4

Your Responsibilities

By using our service, you represent, warrant, and agree that:

  • All information provided in your intake form is accurate, complete, and exactly matches your official government-issued identification and passport
  • You are the lawful account holder for any VFS Global credentials you provide, or you have explicit authorization to use them
  • You meet all eligibility requirements for the visa type you have selected
  • You will attend the appointment we secure on your behalf on the confirmed date and time
  • You will notify us immediately if any of your submitted information changes, including passport details, contact information, or travel plans
  • You will have all required documents prepared and ready for your appointment date
  • You will not hold Visavvy responsible for appointment outcomes arising from inaccurate information you provided
Important: VFS Global may cancel or invalidate appointments if applicant details do not precisely match passport information. Visavvy is not responsible for appointment cancellations arising from inaccurate information you provide.

Section 5

Fees & Payment

Our concierge fee is based on the number of applicants in your booking:

  • Single applicant: $700
  • Two applicants: $1,050
  • Three to five applicants: $1,400
  • Additional children: $500 per child, added to any tier above

Payment is due within 48 hours of receiving your payment link. Monitoring does not begin until payment is received and confirmed. Fees are quoted and charged in US dollars. Any applicable taxes are your responsibility.

VFS government fees and any add-on VFS services selected are paid separately, directly to VFS, and are not collected by Visavvy.


Section 6

Refund Policy

  • Cancellation before booking: If you cancel your service before an appointment is secured, a refund will be issued minus a $75 administration fee for work already performed.
  • No refund after booking: Once an appointment has been successfully booked and confirmed, our service is complete. No refund is provided regardless of whether you attend the appointment, cancel it, or are denied at the door by VFS.
  • Cancellation before payment: No charge. You may withdraw your intake form submission at any time before making payment at no cost.
  • Visavvy-initiated termination: If we terminate the service for reasons within our control, a full refund will be issued. If we terminate due to force majeure, VFS technical changes, or other factors outside our control, a pro-rated refund will be issued based on days of monitoring provided.
  • VFS add-ons: Add-on services selected at booking (courier, photograph, etc.) are paid to VFS and subject to VFS's own refund policies.

Section 7

Credential Security & Privacy

Your privacy and security are taken seriously. With respect to any VFS Global credentials you provide:

  • Credentials are encrypted in transit using TLS and stored using industry-standard encryption at rest
  • Access to credentials is strictly limited to team members who need them to perform the booking service
  • Credentials are used solely for the purpose of monitoring and booking your VFS appointment — never for any other purpose
  • Credentials are permanently deleted from our systems upon appointment confirmation, service termination, or your written request, whichever occurs first
  • We will never share your credentials or personal information with any third party except as required by law

We recommend that after your appointment is confirmed, you change your VFS password as a standard security practice.


Section 8

Limitation of Liability

To the fullest extent permitted by applicable law:

  • Visavvy LLC's total liability to you under this agreement shall not exceed the concierge fee actually paid by you to Visavvy
  • Visavvy shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to: lost profits, missed travel plans, financial losses from delayed relocation, visa denial, or decisions made in reliance on our service
  • Visavvy is not responsible for any actions, decisions, or omissions of VFS Global, Portuguese consular authorities, AIMA, or any government agency
  • Visavvy is not responsible for losses arising from your failure to provide accurate information, attend your appointment, or have required documents ready

Section 9

No Immigration or Legal Advice

Visavvy LLC is not a law firm, immigration consultancy, or accredited immigration representative. Nothing in this agreement, our website, our intake forms, or any communications from Visavvy or its team members constitutes legal advice, immigration advice, or a legal opinion of any kind.

We provide appointment booking assistance only. We have no ability to assess, advise on, or influence the outcome of your visa application. You are solely responsible for ensuring that your application meets all requirements of the Portuguese consulate and immigration authorities.

We strongly recommend consulting a qualified immigration attorney before applying for any Portuguese visa. Visavvy can help you get an appointment — a qualified attorney can help ensure your application is approved.

Section 10

Third-Party Services

Our service involves interaction with VFS Global's booking platform. VFS Global is an independent third party with its own terms of service, privacy policies, and operational decisions. Visavvy has no affiliation with, endorsement by, or contractual relationship with VFS Global.

VFS Global may, at its discretion, modify its platform, cancel appointments, close locations, change booking procedures, or implement technical restrictions. Visavvy is not responsible for any disruption caused by VFS Global's actions or technical changes.


Section 11

Service Termination

  • You may terminate at any time before an appointment is secured by notifying us in writing. A full refund of the concierge fee will be issued within 5 business days.
  • We may terminate if you provide materially false information, violate these terms, or engage in conduct that could harm our service or other clients. In such cases, no refund will be issued.
  • Force majeure termination: If we cannot perform due to circumstances beyond our reasonable control — including VFS system changes, regulatory action, natural disasters, or service outages — we will issue a pro-rated refund and notify you promptly.

Section 12

Governing Law & Disputes

This agreement is governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to this agreement shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules. Arbitration shall take place in Wyoming or by videoconference at the arbitrator's discretion. The arbitrator's decision shall be final and binding. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.


Section 13

Amendments

Visavvy reserves the right to update these Terms of Service at any time. Changes will be posted at this URL with an updated effective date. Continued use of our service after changes are posted constitutes acceptance of the revised terms.

For existing clients with active bookings, material changes to terms will be communicated by email and will not apply retroactively to your existing service agreement without your explicit consent.
